Welcome to QualityApp. These Terms of Service ("Terms") govern your access to and use of QualityApp's software-as-a-service (SaaS) platform, including our website, applications, and integrations (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the Services, you agree to comply with and be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you may not use the Services.

QualityApp reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of the Services following the posting of changes constitutes your acceptance of such changes.

3. Use of 3rd Party Authentication

By using Google OAuth and/or Microsoft OAuth to access QualityApp, you agree to the following:

  • Authorization: You authorize QualityApp to access your Google and/or Microsoft account information, including but not limited to your email address, profile information, and any other data as permitted by the OAuth providers.
  • Data Usage: QualityApp will use the information obtained through Google and Microsoft OAuth to provide and improve our Services. We will not share your personal information with third parties without your consent, except as required by law.
  • Revocation: You can revoke QualityApp's access to your Google and/or Microsoft account at any time through your account settings with the respective OAuth provider. However, revoking access may limit your ability to use certain features of the Services.

4. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Services, you agree to our Privacy Policy.

5. User Conduct

You agree not to use the Services for any unlawful or prohibited purpose. You agree to comply with all applicable laws and regulations. You also agree not to:

  • Misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the operation of the Services.
  • Use the Services to transmit any harmful, threatening, or unlawful content.

All content, trademarks, service marks, logos, and other intellectual property displayed on the Services are the property of QualityApp or its licensors. You agree not to use, reproduce, or distribute any content from the Services without our prior written permission.

The Services are provided "as is" and "as available." QualityApp makes no warranties, express or implied, regarding the Services, including but not limited to any warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, QualityApp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Services by any third party; (v) any errors or omissions in any content; and/or (vi) any defamatory, offensive, or illegal conduct of any third party.

9. Indemnification

You agree to indemnify, defend, and hold harmless QualityApp, its officers, directors, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your use of the Services or your violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
